Who are we?

Who Is The Wilson PC in South Carolina?

The Wilson PC is a multistate personal injury and workers' compensation firm serving Georgia, South Carolina, Alabama, and Illinois. Carolina Happens is our South Carolina home, with offices on Main Street in Columbia and South Main Street in Greenville.

We fight to make sure injured South Carolinians and their families get the compensation, care, and support they deserve. We act as your advocate through the legal, medical, and insurance issues that follow a wreck or a work injury — so you can focus on getting better.

Our South Carolina practice is built around attorneys with deep roots in the state: Dylan Bess, raised in Florence County; Damion Robbs, born and raised in South Carolina; and Kristian Cross, a Columbia native and past Chair of the South Carolina Bar's Workers' Compensation Section.

What Should You Do Right After a Car Accident in South Carolina?

  • Call the police. A police report builds the foundation of your case. South Carolina law requires you to report crashes involving injury.
  • Take photos of the scene. Vehicles, road, skid marks, injuries, and the other driver's plate and insurance card.
  • Pay attention. Anything the other driver admits about what caused the wreck can be used later.
  • Get medical attention. Treatment creates the official record of your injuries — and protects your health.
  • Be patient. Don't give a recorded statement or accept a quick offer. Let us handle the insurance company.
What most accident victims don't know

Every Day You Wait Helps the Insurance Company.

No South Carolina law says you must see a doctor within 24 hours. But adjusters are trained to find any reason to deny or reduce your claim — and a gap in treatment is one of their favorites. If you wait, they'll argue your injuries weren't caused by the crash or the job, or weren't serious. Get checked out as soon as possible, not because the law requires it, but because your claim depends on it.

What Happens When There's No Documentation?

Your attorney can't negotiate what isn't on paper. Your medical records aren't just evidence — they are your claim. If it isn't documented, the insurance company won't count it.

When Did the Adjuster Open Their File?

The second the crash or injury was reported. They log how long you waited to see a doctor, what you said at the scene or to your supervisor, and what you post on social media.

Why Are Hidden Injuries So Often Undervalued?

Whiplash, herniated discs, concussions, and soft-tissue injuries can take 24–48 hours to show up. A prompt evaluation catches what you can't feel yet and locks it into your claim.

Which kind of case do you have?

Is This a Personal Injury Case or a Workers' Comp Case?

South Carolina treats these very differently — different deadlines, different rules, and different money on the table. Here's how they compare.

Personal Injury

Were You Hurt Because Someone Else Was Careless?

Car wrecks, truck crashes, motorcycle and pedestrian accidents, and wrongful death claims are fault-based. You recover from the at-fault party's insurance.

Who pays
The at-fault driver's insurer, or your own UM/UIM coverage
Fault rule
You can recover if you were not more than 50% at fault (modified comparative negligence)
Deadline
Generally 3 years to file suit (S.C. Code § 15-3-530); shorter rules for government defendants
What it covers
Medical bills, lost wages, property damage, and pain and suffering
Workers' Compensation

Were You Hurt While Doing Your Job?

Workers' comp is a no-fault system under Title 42 of the South Carolina Code. Benefits don't depend on who caused the injury.

Who pays
Your employer's workers' comp insurer (most employers with 4+ employees must carry it)
Fault rule
No-fault — you don't have to prove anyone was careless
Deadlines
Report to your employer within 90 days (§ 42-15-20); file with the Commission within 2 years (§ 42-15-40)
What it covers
Authorized medical care, 66⅔% of lost wages, permanent disability — but not pain and suffering

Were you hurt in a wreck while driving for work? You may have both claims at once — workers' comp from your employer's insurer and a personal injury claim against the at-fault driver. We pursue both so you don't leave money on the table.

Find Out What You Have
The mistake most victims make

Going At It Alone vs. Calling Us First.

You've seen the billboards on I-26 and I-85. But the most important thing after a South Carolina wreck or work injury isn't a catchy jingle — it's getting someone in your corner who knows how the process works, from the first ER visit to the final check.

What Happens When You Handle It Alone?

  • The insurance company controls the story from minute one
  • The first offer is built to close your claim fast and cheap
  • No documentation plan — injuries get minimized
  • Recorded statements get used against you
  • You juggle doctors, paperwork, and adjusters yourself
  • The timeline is whatever the insurer decides

What Happens With The Wilson PC From Day One?

  • We take over communication with adjusters and the Commission
  • We know what South Carolina claims are actually worth — and fight for it
  • A documentation strategy starts on day one
  • Contingency fee — you pay nothing unless we win
  • We handle records, police reports, forms, and hearings
  • We push the timeline and don't let them stall
How does it work?

What Happens After You Call Us?

One call. Five steps. Everything handled.

Is the First Consultation Really Free?

Yes. Call or fill out the form. We review your situation, answer your questions honestly, and tell you what we think your case is worth — no pressure, no obligation.

How Do We Investigate Your Case?

Police reports, medical records, witness statements, video, truck black-box data, and employer injury reports — gathered before evidence disappears.

How Do We Build Your Demand or Claim?

For injury cases, a demand reflecting medical bills, lost wages, and pain and suffering. For comp cases, the right forms filed with the SC Workers' Compensation Commission.

Who Talks to the Insurance Company?

We do. We handle every adjuster, defense attorney, and carrier representative. You don't have to take their calls.

What If They Won't Pay What It's Worth?

We're prepared to go further — a lawsuit in the Court of Common Pleas or a hearing before the Commission. We don't settle for less than your case deserves.

What do we handle?

What Kinds of Cases Do We Handle in South Carolina?

From fender benders at Malfunction Junction to warehouse injuries in the Upstate, we represent injured people across South Carolina in two core areas: personal injury and workers' compensation.

Personal Injury

Were You Hurt in a Car Crash?

From rear-end collisions on I-20 to pile-ups on I-95 — even a "minor" wreck is worth a free conversation. Symptoms can take days or weeks to show, and by then the insurer is already building its case.

Personal Injury

Were You Hit by a Semi or Delivery Truck?

When 80,000 pounds meets your car, the injuries are devastating. These cases involve federal trucking rules, black-box data, and multiple liable parties. We don't back down from trucking companies.

Personal Injury

Were You Injured on a Motorcycle?

Riders face bias from adjusters who assume they caused the crash. Road rash, fractures, and head and spinal injuries need an attorney who knows how to fight that bias.

Personal Injury

Were You Hit While Walking or Biking?

Whether you were crossing Main Street in Columbia or riding the Swamp Rabbit area roads in Greenville, when drivers ignore pedestrians and cyclists, we make sure you're compensated.

Personal Injury

Were You Hurt in an Uber or Lyft?

Rideshare wrecks involve layered insurance that shifts depending on whether the app was on and a ride was accepted. We sort out which policy pays — passenger, driver, or pedestrian.

Personal Injury

Did an Uninsured or Hit-and-Run Driver Hit You?

Every South Carolina auto policy must include uninsured motorist coverage, and underinsured coverage may apply too. Hit-and-run claims have strict reporting rules — call police right away, then call us.

Workers' Comp

Were You Hurt on the Job?

Falls, lifting injuries, machine accidents, repetitive stress, and back and neck injuries — whether it happened in one second or built up over ten years, it can be covered by workers' comp.

Workers' Comp

Was Your Workers' Comp Claim Denied or Delayed?

"You reported it too late." "That's a pre-existing condition." "It didn't happen at work." We know the denial playbook — and how to push back before the Commission.

Personal Injury

Did You Lose a Loved One?

These are the hardest cases. We can't bring them back, but we can hold the responsible party accountable and make sure your family is taken care of financially.

What are you entitled to?

What Benefits Does South Carolina Workers' Comp Pay?

In South Carolina, workers' comp can pay your medical bills, about two-thirds of your lost wages, permanent disability, job retraining, and death benefits. What you actually get depends on how badly you're hurt, whether you can work, and how the claim plays out.

BenefitWhat It Covers
Medical careAuthorized doctor visits, surgery, hospital stays, prescriptions, and physical therapy related to the work injury — no dollar cap.
Lost wages66⅔% of your average weekly wage (§ 42-9-10). For injuries on or after Jan. 1, 2026, the max is $1,178.30/week; most benefits cap at 500 weeks.
Permanent disabilityAdded compensation when an injury leaves lasting limits, based on the body part and severity.
Job retrainingVocational rehabilitation if you can't return to your old job.
Death benefitsFuneral costs plus ongoing support for dependents.
What does an accident claim cover?

What Does a South Carolina Accident Settlement Cover?

No two wrecks are the same, but a South Carolina personal injury recovery typically includes:

  • Medical bills — ER, hospital, surgery, physical therapy, chiropractic care, imaging, and future treatment.
  • Lost wages — income lost during recovery, and reduced earning capacity if injuries are long-term.
  • Pain and suffering — physical pain, emotional distress, anxiety, and reduced quality of life.
  • Property damage — repair or replacement of your vehicle and personal property.
  • Wrongful death — funeral costs, lost financial support, and loss of companionship.

The insurer's first offer will sound reasonable. It rarely reflects what your case is worth.

Why does treatment matter?

Where Should You Get Treated After an Accident in South Carolina?

South Carolina's major hospital systems — including Prisma Health in the Midlands and Upstate, MUSC in the Lowcountry, and Spartanburg Regional — handle serious trauma every day. If you're badly hurt, go to the ER first.

For injuries that don't need emergency care — whiplash, soft-tissue damage, herniated discs, back and neck pain — follow-up options include physical therapy, chiropractic care, orthopedic evaluation, and pain management. Getting into treatment quickly matters for your recovery and your claim.

Hurt at work? Your employer or its insurer usually picks the authorized doctor in South Carolina. Go to the ER if it's an emergency, tell every provider exactly how you got hurt, and keep every piece of paperwork.

What Should You Do Right After You're Hurt at Work?

  • Tell your boss the same day — in writing, and keep a copy. You have 90 days, but waiting invites denial.
  • See a doctor — use the employer's approved doctor when you can; go to the ER in an emergency.
  • Follow your treatment plan — missed appointments get used to cut off benefits.
  • Keep records — missed days, pain levels, and what you can no longer do.
  • File with the Commission yourself if needed — don't let the 2-year deadline pass.
  • Call The Wilson PC the moment you hit a wall.

What do people ask us most?

What Do South Carolina Injury Victims Ask Us Every Day?

How much does a personal injury or workers' comp lawyer cost in South Carolina?

Nothing upfront. We work on a contingency fee — you pay no fee unless we recover money for you. In workers' comp cases, attorney fees must also be approved by the South Carolina Workers' Compensation Commission, which protects you.

How long do I have to file a car accident claim in South Carolina?

Most South Carolina personal injury lawsuits must be filed within three years of the accident. Claims against a state or local government agency can have shorter deadlines and notice requirements. Don't cut it close — building a strong case takes time.

How long do I have to report a work injury in South Carolina?

You must report it to your employer within 90 days under S.C. Code § 42-15-20, and you generally have two years to file your claim with the Workers' Compensation Commission under § 42-15-40. Reporting to your boss is not the same as filing the claim — and the two-year clock keeps running.

Can I still recover money if I was partly at fault for the wreck?

Yes, as long as you were not more than 50% at fault. South Carolina follows modified comparative negligence, so your recovery is reduced by your share of fault but not wiped out. Don't assume you have no case.

Can I be fired for filing a workers' comp claim in South Carolina?

South Carolina law prohibits firing you in retaliation for filing a workers' comp claim. Employers can still act for other legitimate reasons, but if you were let go right after filing, that timing is suspicious — talk to us.

How Much Time Do You Have Left Before the Insurance Company Wins?

They started their clock at the moment of impact. You still have time — but not unlimited time. Whether you were hurt on I-26, I-85, I-95, US-17, or on a job site in Rock Hill, Spartanburg, or North Charleston, we're here. You didn't ask for this, but you do have rights, and we'll help you use them.
